Issues

Craig defended a general surgeon in a lawsuit brought by the parents of a six-year old girl who died following a tonsillectomy.  Six days after surgery and after having been discharged from the hospital, the girl suffered secondary hemorrhage, a well-known phenomena following tonsillectomy that unfortunately could not be stopped prior to the girl’s death.  The family was a poor family who did not have access to a telephone to call for emergency help.  By the time the ambulance arrived at the home, the girl had already lost too much blood to be resuscitated.  The parents brought this lawsuit alleging that the Defendant general surgeon negligently performed the tonsillectomy that then caused the secondary hemorrhage.  After a one-week jury trial, the jury returned a verdict in favor of the Defendant physician and against the Plaintiff.
